OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees (a) The employer shall have a competent person determine the feasibility and safety of providing fall protection for employees erecting or dismantling catch platforms. Employers are required to provide fall protection for employees erecting or dismantling catch platforms where the installation and use of such protection is feasible and does not create a greater hazard.

29 CFR 1926.454(c): When the employer has reason to believe that an employee lacks the skill or understanding needed for safe work involving the erection, use or dismantling of scaffolds, the employer shall retrain each such employee so that the requisite proficiency is regained. Retraining is required in at least the following situations: (a) At the I-75 Bridge Replacement Project in Rocky Face, GA: Employees involved in dismantling a temporary platform were not trained by a competent person to recognize the hazards associated with the work in question. The employee were not trained on specific topics such as , but not limited to the correct procedures for dismantling the platform, and the design criteria and maximum intended load-carrying capacity.
