OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to struck-by and caught-in/under hazards while an employee backed up a motor grader: a) On or about 03/04/2016 - I-22, mile marker 54.7, Jasper, AL, an employee was struck by a Komastu, GD655, ID#GH7557, motor grader. The operator was backing the motor grader without a spotter approximately 82 feet before he struck the employee operating a chop saw to make cuts in the asphalt.
