29 CFR 1926.95(a): "Application." Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, shall be provided, used, and maintained in a sanitary and reliable condition wherever it is necessary by reason of hazards of processes or environment, chemical hazards, radiological hazards, or mechanical irritants encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption, inhalation or physical contact.    (a) Building No. 3 - On or about March 30, 2016 employee was exposed to a chemical hazard while applying diluted Muriatic acid to an exterior brick wall. The employee was not using PPE, such as and not limited to, protective eye goggles, gloves and protective clothing.

29 CFR 1926.451(c)(1)(ii):  Guys, ties, and braces shall be installed according to the scaffold manufacturer's recommendations or at the closest horizontal member to the 4:1 height and be repeated vertically at locations of horizontal members every 20 feet (6.1 m) or less thereafter for scaffolds 3 feet (0.91 m) wide or less, and every 26 feet (7.9 m) or less thereafter for scaffolds greater than 3 feet (0.91 m) wide. The top guy, tie or brace of completed scaffolds shall be placed no further than the 4:1 height from the top. Such guys, ties and braces shall be installed at each end of the scaffold and at horizontal intervals not to exceed 30 feet (9.1 m) (measured from one end [not both] towards the other).    (a) Building No. 3 - On or about March 30, 2016 employee was cleaning an exterior bricks wall while working from scaffolding that was not secured to the structure.    - East Side. 29 CFR 1926.451(e)(1): scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from another scaffold, structure, personnel hoist, or similar surface shall be used. Crossbraces shall not be used as a means of access.    (a) Building No. 3 - On or about March 30, 2016 employee used the crossbraces of a scaffold to climb down to the ground.       - East Side. 29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety data sheets.   (a)  Building No. 3 - On or about March 30, 2016 employee was exposed to health hazards while mixing and applying Muriatic acid to be used in cleaning brick masonry. The employer did not provide hazardous communication training to the exposed employee.
