29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE):    a) 35 Thousand Oaks Blvd - The employer assigned temporary workers to PhytogenX  Inc. in Morgantown Pennsylvania. The employer did not evaluate or determine that these workers were being exposed to hazardous chemicals including but not limited to flammable liquids. Temporary employees were required to clean equipment with 70% isopropyl alcohol and 99% isopropyl alcohol and worked in processes that involved the use, transfer, and/or bottling of products containing 96% ethyl alcohol (SDA 40B) on or about December 17, 2015.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment:    a) 35 Thousand Oaks Blvd - The employer did not certify through written certification that their workplace hazard assessment was completed, on or about December 17, 2015.    Abatement certification required within 10 days after abatement date.  The certification shall include a statement that abatement is complete, date and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:    a) 35 Thousand Oaks Blvd - Temporary workers assigned to Phytogenx were not provided SDS training, categories of hazards such as flammability, carcinogenicity, appropriate work practices, emergency procedures, proper personal protective equipment and other physical or health hazards regarding chemicals including but not limited to: 70% Isopropyl alcohol, 96% ethyl alcohol (SDA 40B), 99% Isopropyl alcohol during batching, transferring, processing, storing and shipping operations on or about April 7 2016.     Abatement certification and documentation required within 10 days after abatement date. The certification shall include a statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.
