29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(c): Instance A: On or about April 15, 2006, an employee was exposed to cave-in hazards while working in an approximately 28 feet long by 16 feet wide and 13 feet deep excavation when the soil wall extended approximately 4 feet above the trench box. Instance B: On or about April 14, 2016, an employee was exposed to cave-in hazards while working in an approximately 26 feet 6 inch long by 14 feet 7 inch wide and 13 feet deep excavation.
