Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to crushing and/or struck by hazards: (a) On or about April 19, 2016 and at times prior, employees were exposed to crushing and/or struck by hazards while moving approximately eight railcars on the east plant tracks with a single rope attached to a tractor at 202 Minneapolis Avenue, Fullerton, North Dakota. (b) On or about April 19, 2016 and at times prior, employees were exposed to crushing and/or struck by hazards while moving approximately two railcars on the west plant tracks with a shop built fixture attached to a payloader at 202 Minneapolis Avenue, Fullerton, North Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard would be to: 1. Utilize equipment designed to safely move railcars including, but not limited to, mobile railcar movers or railcar coupler attachments. 2. Conduct a hazard assessment of the work process. 3. Established and implemented safe procedures for the movement and placement of the railcars. 4. Trained employees in the safe procedures. 5. Utilized other engineering technology.

Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to crushing and/or struck by hazards: (a) On or about April 12, 2016 and at times prior, employees were exposed to crushing and/or struck by hazards while the manually propelled rope man lift was operated allowing access under the lift when it was elevated at 202 Minneapolis Avenue, Fullerton, North Dakota. Abatement Note: Among other methods, one feasible and acceptable method to correct this hazard would be to install a guardrail system around the perimeter base of the man lift.
