29 CFR 1910.28(b)(3)(ii): Each employee was not protected from tripping into or stepping into or through any hole that is less than 4 feet (1.2 m) above a lower level by covers or guardrail systems: a) On September 20, 2023, and at times prior, employees entering the east most grain bin at the east plant located at 202 Minneapolis Avenue in Fullerton, North Dakota, were exposed to tripping hazards where grates or covers were not used to cover the floor holes inside the bin.

29 CFR 1910.272(g)(1)(ii): Prior to bin entry, all mechanical, electrical, hydraulic, and pneumatic equipment which presented a danger to employees inside grain storage structures in the grain handling facility were not disconnected, locked out and tagged, blocked-off, or otherwise prevented from operating by other equally effective means or methods: a) On September 20, 2023, at Fullerton Farmers Elevator at 202 Minneapolis Avenue in Fullerton, North Dakota, employees were exposed to caught-in and/or amputation hazards while entering a grain bin where the sweep auger was not locked out or otherwise isolated from operating.
