29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required:   a. In regards to citation 1, item 1, issued on June 3, 2016, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, July 8, 2016.  The violation read as follows:     29 CFR 1910.95(c)(1): The employer shall administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. For purposes of the hearing conservation program, employee noise exposures shall be computed in accordance with appendix A and Table G-16a, and without regard to any attenuation provided by the use of personal protective equipment:   a.  At the establishment, the employer had not established and implemented an effective hearing conservation program for employees with noise exposures equal to or exceeding an 8-hour TWA sound level of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of 50 percent. An employee operating the DoAll grinder and DoAll band saw was exposed to noise at 78.45%, which exceeded the action level (AL) of 50%, an 8-hour TWA sound level of 85 dBA. The employee's 8-hour TWA sound level was approximately 88.3 dBA during the 360 minute sampling period on April 21, 2016. Exposure calculation included a zero increment for the 120 minutes not sampled.       b.  At the establishment, the employer had not established and implemented an effective hearing conservation program for employees with noise exposures equal to or exceeding an 8-hour TWA sound level of 85 decibels measured on the A scale (slow response) or, equivalently, a dose of fifty percent. An employee operating the fork lift, DoAll band saw and DoAll grinder was exposed to noise at 153.4%, which exceeded the permissible exposure level (PEL) of 100%, an 8-hour TWA sound level of 90 dBA. The employee's 8-hour TWA sound level was approximately 93.1 dBA during the 339 minute sampling period on April 21, 2016. Exposure calculation included a zero increment for the 141 minutes not sampled.
