29 CFR 1903.19(d)(1): The employer must submit to the Agency, along with the information on abatement certification required by paragraph (c)(3) of this section, documents demonstrating that abatement is complete for each willful or repeat violation and for any serious violation for which the Agency indicates in the citation that such abatement documentation is required.   a. In regards to citation 1, item 1, issued on June 14, 2016, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, July 1, 2016.  The violation read as follows:       29 CFR 1910.178(l)(1)(i): The employer shall ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):     a. On or before April 19, 2016, where temporary employees operated forklifts, the employer failed to ensure employees were competent to operate forklifts through training and an evaluation, thereby exposing the employees to struck-by or other hazards.     b. In regards to citation 1, item 2, issued on June 14, 2016, the employer has failed to submit abatement certification and documentation within ten days of the abatement date, July 17, 2016.  The violation read as follows:       29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are barrier guards, two-hand tripping devices, electronic safety devices, etc:     a. On or before April 19, 2016, where employees used a band saw to cut plastic materials, the unused portion of the band saw blade, guide wheels, and area above the guide wheels were not guarded, and the existing guard was not lowered to the height of the material being cut, thereby exposing the employees to contact hazards.
