29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc.  a. On or before December 8, 2016, where employees worked on or near the shredder, the rotating ram was not guarded, thereby exposing the employees to a caught-in hazard.

29 CFR 1910.178(l)(6): Certification. The employer shall certify that each operator has been trained and evaluated as required by this paragraph (l). The certification shall include the name of the operator, the date of the training, the date of the evaluation, and the identity of the person(s) performing the training or evaluation.  a. On or before December 8, 2016 where employees were trained on the operation of powered industrial vehicles, such as, but not limited to, sit down forklifts, the training was not certified to include the following: the date of the training, the date of the evaluation, and the identity of the trainer.
