29 CFR 1926.1053(b)(1): When portable ladders were used for access to an upper landing surface, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension was not possible because of the ladder's length, then the ladder was not secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, was not provided to assist employees in mounting and dismounting the ladder:    a) Worksite, second story, roof access hatch, on April 29, 2016, and at time prior, the ladder used to access the roof did not extend, although it was attached by screws to a wood brace, no rigid grab bar was provided, employees could slip and fall when mounting or dismounting the ladder.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not marked in a manner that readily identified them as defective, tagged with "Do Not Use" or similar language, or withdrawn from service until repaired:    a) Worksite, second story, roof access hatch, on April 29, 2016, and at times prior, the first/bottom rung of the ladder used to access the roof, was broken, employees could step through causing injury.

29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels, was not protected from falling by guardrail systems, safety net systems, personal fall arrest system:    a) Worksite - on April 29, 2016, and at times prior, employees were working at the edge of the roof, exposed to a fall of 30 feet to the ground below, without the use of guardrails, safety nets, or a personal fall arrest system.    J. Luke Construction was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(1), which was contained in OSHA inspection number 1107932, citation number 1, item number 1 and was affirmed as a final order on April 18, 2016, with respect to a workplace located at 25 Mohawk Ave, Scotia, NY 12302.
