29 CFR 1910.38(a): 29 CFR 1910.38(a)(1): The emergency action plan required by 29 CFR 1910.157(a) or (b) when the employer has elected to partially or totally evacuate the workplace in the event of a fire emergency, or required by 29 CFR 1910.160(c)(1), did not cover the designated actions that the employer or employees must take to ensure employee safety from the fire and other emergencies: On or about May 24, 2016, the employer had the following deficiencies in their EAP. The employer did not develop and review the EAP with each employee in the new packaging department to include the evacuation routes and emergency exit locations. Employees in the packaging department are expected to evacuate in the situation of a fire.

29 CFR 1910.37(b)(5): Each doorway or passage along an exit access that could be mistaken for an exit was not marked "Not an Exit" or similar designation, or be identified by a sign indicating its actual use (e.g. closet): On or about May 24, 2016, the employer did not mark the doorway leading outside as "not an exit". The company has designated two doors that lead to the backside of the building as not to be used as an exit. One of the doors was marked and the other was not. The area was recently turned into the packaging department and employees have not been trained on the new emergency exit routes to be used in this department.
