29 CFR  1910.212(a)(1):Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.   On or about January 23, 2024, the employer did not ensure one or more methods of machine guarding was provided to protect employees passing between the openings in Press No. 4 Main Packaging Line from struck-by hazards created by the extruded aluminum parts moving along the line.

29 CFR  1910.219(f)(3):Sprockets and chains. All sprocket wheels and chains shall be enclosed unless they are more than seven (7) feet above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets.  On or about January 23, 2024, the employer did not ensure the chain and sprocket wheels used for the power transmission between an electric motor and a conveyor roller of the Press No. 4 Main Packaging Line was fully enclosed (guarded).  The chain and sprocket wheels were less than seven feet above the shop floor.

29 CFR  1904.39(a)(2):Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.  On or about January 25, 2024, the employer did not report within 24 hours the amputation injury of an employee who received a partial fingertip amputation injury to his right finger in the workplace on or about January 23, 2024.  The employer was notified the injury resulted in an amputation injury on or about January 24, 2024, and OSHA was not notified of the amputation injury until on or about February 6, 2024, via the OSHA online injury reporting webpage.
