29 CFR 1910.269(d)(2)(i): The employer shall establish a program consisting of energy control procedures, employee training, and periodic inspections to ensure that, before any employee performs any servicing or maintenance on a machine or equipment where the unexpected energizing, start up, or release of stored energy could occur and cause injury, the machine or equipment is isolated from the energy source and rendered inoperative. At the time of the inspection, employees were exposed to the hazard of coal dust deflagration and explosion while working in the coal crusher building. The employer had not implemented an energy control procedure to prevent the unexpected startup of the dust collection system while employees were working inside equipment and chute-work. The inspection found that the backdraft damper technology installed in the dust collection system is not designed for personnel explosion/deflagration protection. Abatement certification and abatement documentation is required for this violation. The documentation should include written verification of abatement, applicable measurements or monitoring results, and photographs or videos which you believe will be helpful. The abatement certification sheet is enclosed with the citations.
