29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces shall be protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes. (a)Mueller Lumber Company @ 25925 350th Ave., Pukwana, SD 57370: On and prior to May 31, 2016, the employer did not ensure each employee on a walking/working surface having an unprotected stairway floor hole was protected from falling to lower levels more than six feet by personal fall arrest systems, covers, or guardrail system erected around such holes. Employees were handling building material on the first floor of a single family home under construction when an employee fell through a stairway floor hole. The employee fell approximately 10 feet and landed on the concrete floor of the basement. This condition exposed employees to a fall hazard of approximately 10 feet.

29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached) where the outside bottom edge of the wall opening is 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 m) above the walking/working surface, shall be protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system. (a)Mueller Lumber Company @ 25925 350th Ave., Pukwana, SD 57370: On and prior to May 31, 2016, the employer did not ensure each employee working near a wall opening which consisted of a picture window located on the first floor of a one-story residential structure were protected from fall hazards to lower levels by the use of guardrail system, a safety net system, or a personal fall arrest system. The window opening measured approximately 23 inches from the floor. This condition exposed employees to a fall hazard of approximately 9 feet 8 inches.
