29 CFR 1926.502(b)(13): When guardrail systems were used around holes which were used as access (such as ladderways), they were not provided with a gate, or were not so offset that a person could not walk directly into the hole: a) North west corner of roof deck: On June 1, 2016 and at times prior thereto the controlling employer, Barry Hayes Construction, LLC did not ensure that its sub-contractors protected their employees when working around a floor access hole. The floor access hole did not have a complete guardrail system in place. Note) Corrected during inspection.

29 CFR 1926.1051(a): A stairway or ladder was not provided at all personnel points of access where there is a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist is provided: a) East and west sides of building: On June 1, 2016 and at times prior thereto the controlling employer, Barry Hayes Construction, LLC, did not ensure that their employees and the sub-contractor employees were protected from trip and fall hazards where access points in and out of the building were greater than 19 inches high. Some areas had un-even ground and pipe protruding from the building. Note) Corrected during the inspection.

29 CFR 1926.20(b)(2): Programs did not provide for frequent and regular inspections of the job sites, materials, and equipment to be made by competent persons designated by the employers: a) Jobsite, north west corner of roof deck: On June 1, 2016 and at times prior thereto the controlling employer, Barry Hayes Construction, LLC, did not ensure through frequent and regular inspections that its framing sub-contractor protected their employees . As the work site progressed, fall protection systems that had been in place were not maintained. Part of a guardrail system around a roof deck access hole was removed, exposing employees to a 13.2 foot fall hazard to the floor below. b) Jobsite, west side of building: On June 1,2016 and at times prior thereto the controlling employer, Barry Hayes Construction, LLC, did not ensure through frequent and regular inspections that their own employees and employees of their sub-contractors were protected from trip and fall hazards at access points into the building. No step or ramp was provided in areas where the break in elevation was more than 19 inches, while in an other area the ramp provided was 7 inches wide. Note) Corrected during the inspection. Barry Hayes Construction, LLC was previously cited for a violation of this occupational safety and health standard, 29CFR 1926.20(b)(2), which was contained in OSHA inspection number 1120453, citation number 1, item number 1b and was affirmed as a final order on May 25, 2016, with respect to a workplace located at 521 Carrie Rex Ave, Melba, ID 83641.
