29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) 1735 Mulberry Way, Yardley, PA, Worksite - on or about June 29, 2016, employees were using the fly section of an aluminum extension ladder to access the second floor of a residential home project, approximately nine feet above grade, but the rungs did not extend at least 3 feet above the upper landing surface.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501(b):  a) 1735 Mulberry Way, Yardley, PA, Worksite - The employer does not ensure that appropriate fall protection equipment or methods are in use. This continuing violation was most recently observed on or about June 29, 2016, when employees performing frame carpentry activities on a residential home project, between approximately eight and 25 feet above grade, were working without utilizing any means of fall protection. The employer's ongoing obligation is to ensure that the necessary fall protection equipment and/or methods are in use for the duration of the fall hazard.

29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed:  a) 1735 Mulberry Way, Yardley, PA, Worksite - The employer does not ensure that employees are using portable stepladders in the manner for which they were designed. This continuing violation was most recently observed on June 29, 2016, when employees were using a stepladder, which was leaned against an interior wall, to access the interior top plate of a residential home project. The employer's ongoing obligation is to ensure that portable stepladders are used as a supported ladder, as they were designed.
