29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met (Construction Reference: 1926.59):   a) Residential Construction, Lot 11 - on or about March 15, 2016, employees used Titebond all-weather subfloor adhesive during framing operations, but the employer did not comply with the requirements set forth in Part 1910, Section 1200.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area:  a) Residential Construction, Lot 11 - on or about March 15, 2016, employees used Titebond all-weather subfloor adhesive during framing operations,  but the employees had not received the Hazard Communication training necessary to prevent injuries and illnesses caused by working with materials containing hazardous chemical contents.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Residential Construction: framed roof area, Lot 11 - on or about March 15, 2016, employees were engaged in framing carpentry work on a residential home project and were working from the top plates and within the truss work without any means of fall protection, exposing employees to falls greater than 18 feet to lower levels.  b) Residential Construction: second story, Lot 11 - on or about March 15, 2016, employees were engaged in framing carpentry work on a residential home project and were walking and working throughout areas on the second story with window openings not guarded and no other means of fall protection used, exposing employees to falls greater than 10 feet to lower levels.  c) Residential Construction: first floor, Lot 11 - on or about March 15, 2016, employees were engaged in framing carpentry work on a residential home project and were walking and working on areas of the first floor with a hole opening for the staircase which was not guarded to protect employees from falling to the basement level below, exposing employees to falls greater than 8 feet to the lower level.

29 CFR 1926.602(c)(1)(vi): Industrial truck(s) in use did not meet the applicable requirements of design, construction, stability, inspection, testing, maintenance, and operation, as defined in American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.  a) Residential Construction, Lot 11 - on or about March 15, 2016, an employee operated a Pettibone rough terrain forklift, model B-66-0, to place decking materials onto the second story, but the forklift leaked hydraulic oil and did not meet the applicable requirements of inspection and maintenance as defined in the American National Standards Institute B56.1-1969, Safety Standards for Powered Industrial Trucks.
