29 CFR 1960.8(a):  The Agency head did not furnish employment and a place of employment to each employee that were free from recognized hazards that caused or were likely to cause death or serious physical harm in that employees were exposed to fall hazards while utilizing a fiberglass step ladder impropertly.    a) FBI Sensitive Location, Newark Division, Newark NJ:  The Husky 10 foot step ladder was being used in the closed position to access the upper mezzanine and due to the ladders length, required the employees to step on the top step of the ladder.  This hazard was observed on 6/1/16.

29 CFR 1910.22(d)(1): On every building or other structure, or part thereof, used for mercantile, business, industrial or storage purposes, the loads approved by the building official were not marked on plates of approved design and securely affixed in a conspicuous place in each space to which they relate.  a) Sensitive Location, Newark Division, Newark, NJ:  The upper mezzanine, which was used for storage and employee access, was not marked with the rated floor capacity.  This hazard was occurred on 6/1/16.

29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:  a)  Sensitive Location, Newark Division, Newark, NJ:   The upper mezzanine area above the office space was not equipped with a guardrail or other means of fall protection along the open edge.  This exposed employees of fall hazards of up to 10 feet.   This hazard occurred on 6/1/16.
