OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970:  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards:  a) On or about July 15, 2016, employees were exposed to the hazard of being struck-by and/or crushed where safety barriers were not set up to protect the sides and rear areas of the swing pattern (swing areas and blind spots) of an excavator.       In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.  This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.   Among others, feasible and acceptable methods of abatement would include, setting up safety barriers to the sides and rear of the excavator's swing patters to prevent anyone from walking into the working area as described in the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652 (b) or (c) of this section:        a) On or about July 15, 2016, employees were exposed to cave-in and struck-by hazards while preparing footings without being protected from cave-ins by adequate shoring, sloping, or other protective means when working along the north and south vertical excavation walls at a depth of approximately 10 feet.      In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation; item f (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. 29 CFR 1926.652(e)(1)(ii): Support systems were not installed and removed in a manner that protected employees from cave-ins, structural collapses, or from being struck by members of the support system:   a) On or about July 15, 2016, employees were exposed to struck-by and crushing hazards while installing plywood sheathing and angle during the construction of a support system installed along the west vertical exaction wall at a depth of approximately 10 feet.     In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification.
