OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing and struck-by hazards: a) On or about November 8, 2016, employees were exposed to the hazard of being struck-by and/or crushed where safety barriers were not set up to protect the sides and rear areas of the swing pattern (swing areas and blind spots) of an excavator. Goose Lake Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard OSH ACT of 1970 Section (5)(a)(1) which was contained in OSHA inspection number 1162229, citation 1, item 1, and was affirmed as a final order on August 16, 2016, with respect to a worksite located at 2515 W. Lawrence, Chicago, Illinois. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records. Among others, feasible and acceptable methods of abatement would include, setting up safety barriers to the sides and rear of the excavator's swing patters to prevent anyone from walking into the working area as described in the Equipment Manufacturers Institute Safety Manual for Hydraulic Excavators.

Goose Lake Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.100(a) which was contained in OSHA inspection number 1162229, citation 1, item 2, and was affirmed as a final order on August 16, 2016, with respect to a worksite located at 2515 W.
