OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, the employer is failing to protect the employees from struck by hazards associated with uninstalling a storm damaged overhead garage door.  The most recent example of this was found at the facility located at 74237 Road D, Bertrand, NE where the employer had four installers disassembling a storm damaged overhead garage door; the employees were using a grinder to cut the spring assembly free of the building, as the final cut was made the stored tension on the spring twisted the assembly around cutting the injured employee on the forearm with the bearing plate that held the assembly to the structure resulting in the employees admission and in-patient treatment at the local hospital.       FEASIBLE AND ACCEPTABLE METHODS OF ABATEMENT TO CORRECT THIS HAZARD INCLUDES BUT IS NOT LIMITED TO:   a.     The spring assembly is secured against spinning or twisting by clamping the springs and rod together.   b.    The spring assembly is secured to the structure during the process of cutting the center rod to prevent the spring assembly from spinning uncontrolled.   c.     Using the tension bar to release the stored energy on the spring prior to disassembly.

29 CFR 1904.39(a)(2): Basic Requirement. Within twenty-four (24) hours after the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, you must report the in-patient hospitalization, amputation, or loss of an eye to OSHA.     The employer has failed to report an in-patient hospitalization to OSHA within 24 hours.  This most recent occurrence of this took place at the facility located at 74237 Road D, Bertrand, NE where on July 15, 2016 the employer had four installers disassembling a storm damaged overhead garage door; the employees were using a Sawzall to cut the spring assembly free of the building, as the final cut was made the stored tension on the spring twisted the assembly around cutting the injured employee on the forearm with the lag bolts that held the assembly to the structure resulting in the employees admission and in-patient treatment at the local hospital.  The employer did not report the incident to OSHA until July 18th.
