29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person. WORKSITE: The employer did not ensure through specific instruction and/or visual observation that a designated competent person at the worksite did conduct frequent and regular inspections of the worksite, materials, and equipment prior to allowing employees to go into the excavation where overhanging and unsupported asphalt was not protected against the hazard of falling into the excavation. On or about May 19, 2016, a section of asphalt from the roadway broke apart and fell striking an employee who was in the excavation inspecting the concrete form prior to a concrete pour, and the employee sustained severe injury to right hand from the incident.

29 CFR 1926.651(i)(3): Sidewalks, pavements, or appurtenant structures had been undermined and a support system or another method was not provided to protect employees from the possible collapse of such structures: WORKSITE: The roadway containing overhanging asphalt was undermined and not adequately and appropriately supported to protect the employees working in the excavation. On or about May 19, 2016, a section of asphalt from the roadway broke apart and fell striking an employee who was in the excavation inspecting the concrete form prior to a concrete pour, and the employee sustained severe injury to right hand from the incident.
