29 CFR 1926.102(a)(1): Eye and face protective equipment were not used when machines or operations presented potential eye or face injury from physical, chemical, or radiation agents:  a.   On or about August 5, 2016, on the northeast side of the framed structure, an employee installing roofing sheets to the frame while using a pneumatic nail gun did not wear eye protection, exposing the employee to the hazard of being struck in the eye or face by flying debris.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a.  On or about August 5, 2016, on the second level of a new residential home on the east side, an employee installing framing materials was not protected from a 19 feet 8 inch fall hazard by the use of a personal fall protection system.  b.  On or about August 5, 2016, on the second level of a new residential home on the west side, two employees installing framing materials were not protected from a 20 feet 1 inch fall hazard by the use of a personal fall protection system.  Ninja Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926 501(b)(13), which was contained in OSHA inspection number 1128548 citation number 01, item number 01 and was affirmed as a final order on May 3, 2016, with respect to a workplace located at 213 Wiregrass Lane, Panama City Beach, FL 32407.  The Heritage & Son Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(13), which was contained in OSHA inspection number 1078391, citation number 1, item number 1 and was affirmed as a final order on September 3, 2015, with respect to a workplace located at Prominence Phase One North, Santa Rosa Beach, Florida 32459.  Heritage & Son Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 988120, citation number 01, item number 02 and was affirmed as a final order on September 18, 2014 with respect to a workplace located at 29 Royal Fern Way, Lot 31, Santa Rosa beach, FL 32459.  Heritage & Son Company was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(1), which was contained in OSHA inspection number 1049184, citation number 02, item number 01 and was affirmed as a final order on September 4, 2015 with respect to a workplace located at 35 Grayling Way, Lot 5, Inlet Beach, FL 32413.
