29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation.  (a)  All around the house - On or about August 12, 2016 employees were exposed to a flying object hazard while using nail guns.  None of these employees were wearing eye protection.     (b)  All around the house - On or about August 19, 2016 employees were exposed to a flying object hazard while using nail guns.  None of these employees were wearing eye protection.

29 CFR 1926.451(b)(2): Except as provided in paragraphs (b)(2)(i) and (b)(2)(ii) of this section, each scaffold platform and walkway shall be at least 18 inches (46 cm) wide.  (a)  Roof of the house - On or about August 19, 2016 an employee was exposed to a fall hazard while working on a wooden scaffold with walkway less than 18 inches.  The scaffold walkway was only 12 inches wide and 18 feet 6 inches above concrete.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  (a)   Rafter  scaffold - On or about August 19, 2016 an employee was exposed to a fall hazard while working on a wooden scaffold 18 feet 6 inches above concrete with no fall protection.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems.  (a)    Right side roof ledge - On or about August 12, 2016 two employees were exposed to a fall hazard while working on a roof ledge with no fall protection.  One of these employees was 11 feet 7 inches above the ground.     (b)   Front roof ledge - On or about August 19, 2016 an employee was exposed to a fall hazard while working on a roof ledge with no fall protection.  One of these employees was 11 feet 7 inches above the ground.

29 CFR 1926.1053(b)(4): Ladders shall be used only for the purpose for which they were designed.  (a)  Back of the house - On or about August 19, 2016 an employee was exposed to a fall hazard due to using an 8 foot step to access a 9 foot 7 inch roof this ladder was not used for its designed purpose. The legs of the step ladder were not placed on a level surface.

29 CFR 1926.1060(a): The employer shall provide a training program for each employee using ladders and stairways, as necessary. The program shall enable each employee to recognize hazards related to ladders and stairways, and shall train each employee in the procedures to be followed to minimize these hazards.  (a)   CV Construction - On or about August 19, 2016 the employer did not train each employee using ladders on how to recognize and minimize the hazards associated with ladders. Employees demonstrated an inability to use ladders safety. 1) Employees stood on the tops of step ladders. 2) Employees did not place a step ladder on all 4 legs on a level surface. 3) Employees used an 8 foot step ladder to access a 9 foot 7 inch landing this ladder was not used for its designed purpose.  4) The ladder was also not extended 3 feet over the landing.   The employer also admitted he did not provide any ladder safety training.
