29 CFR 1926.652(a)(1): 29 CFR 1926.652(a)(1) Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c): a) On or about 8/18/16 at a water line repair project located on Angle Road near Taylor Drive, West Seneca, New York; employees were in an excavation exposing pipes for a service repair. The excavation was approximately 5 to 6 feet deep with vertical walls and was not protected from cave-ins. NO ABATEMENT CERTIFICATION REQUIRED DJM Contracting Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard, which was contained in OSHA inspection number 1084904, citation number 1, item number 1 and was affirmed as a final order on 10/13/15, with respect to a workplace located at 9375 Boston State Road, Boston, New York.
