29 CFR 1910.178(q)(6): Industrial trucks shall not be altered so that the relative positions of the various parts are different from what they were when originally received from the manufacturer, nor shall they be altered either by the addition of extra parts not provided by the manufacturer or by the elimination of any parts, except as provided in paragraph (q)(12) of this section. Additional counterweighting of fork trucks shall not be done unless approved by the truck manufacturer. (a) Department 25 - On or about September 07, 2016 the employer installed a front windshield to a TCM 25 No. 106 forklift that was covered with paint overspray and dust.

29 CFR 1910.178(q)(7): Industrial trucks shall be examined before being placed in service, and shall not be placed in service if the examination shows any condition adversely affecting the safety of the vehicle. Such examination shall be made at least daily. Where industrial trucks are used on a round-the-clock basis, they shall be examined after each shift. Defects when found shall be immediately reported and corrected. (a) Department 25 - On or about September 07, 2016 TCM 25 No. 106 forklift, used in material handling operations, was not being inspected for defects on a daily basis before placing into service and any defects when found shall be immediately reported and corrected.

29 CFR 1910.184(e)(4): Proof testing. The employer shall ensure that before use, each new, repaired, or reconditioned alloy steel chain sling, including all welded components in the sling assembly, shall be proof tested by the sling manufacturer or equivalent entity, in accordance with paragraph 5.2 of the American Society of Testing and Materials Specification A391-65, which is incorporated by reference as specified in Sec. 1910.6 (ANSI G61.1-1968). The employer shall retain a certificate of the proof test and shall make it available for examination. (a) Department 25 Paint - On or about September 07, 2016 employer has not proof tested alloy steel chains that have been cleaned with an abrasive blasting process.
