29 CFR 1926.100(a): Employees working in areas where there was a possible danger of head injury from impact, or falling or flying objects, or from electrical shock and burns, were not protected by protective helmets:  Location: 45 Highland Ave Lowell MA  On or about October 5, 2016, the employer did not ensure that employees were wearing hard hats while working on low sloped roofs with employees working on the roof above them.    This violation was most recently observed on October 5, 2016 at a jobsite located at 45 Highland Ave, Lowell, MA 01851 where employees were not wearing hard hats with overhead hazards present.  To abate this violation, the employer must ensure that employees wear hard hats anytime overhead hazards are present.

This violation was most recently observed on October 5, 2016 at a jobsite located at 45 Highland Ave, Lowell, MA 01851 where the ladder jack scaffold was within the minimum approach distance for uninsulated lines.  To abate this violation, the employer must ensure that ladder jack scaffolds are not within the minimum approach distance.

Location: 45 Highland Ave, Lowell MA    On or about October 5, 2016, employees exposed to falls in excess of 22 feet on a steep roof were not protected from falling to lower levels or the ground.    This violation was most recently observed on October 5, 2016 at a jobsite located at 45 Highland Ave, Lowell, MA 01851 where employees were exposed to fall hazards greater than  ten feet and 22 feet.  To abate this violation, the employer must ensure that employees are wearing fall protection at all times when exposed to falls greater than six feet.

Luis Quindi dba Speedy Gonsales was previously cited for a violation of this occupational safety and health standard 1926.102(a)(1), which was contained in OSHA inspection number 1078346, citation number 1, item number 1 and was affirmed as a final order on November 30, 2015, with respect to a workplace located at 4 Weetamo Way Westford, MA.  This violation was most recently observed on October 5, 2016 at a jobsite located at 45 Highland Ave, Lowell, MA 01851 where employees were exposed to flying projectiles without the use of eye protection.  To abate this violation, the employer must ensure that employees are wearing eye protection while using nail guns.

Luis Quindi dba Speedy Gonsales was previously cited for a violation of this occupational safety and health standard 1926.452(b)(5)(ii), which was contained in OSHA inspection number 992151, citation number 3, item number 1 and was affirmed as a final order on October 24, 2014, with respect to a workplace located at Newell Meadow Condominiums, Chester Rd., Derry, NH 03038.  This violation was most recently observed on October 5, 2016 at a jobsite located at 45 Highland Ave, Lowell, MA 01851 where the platform of the ladder jack scaffold extended more than 18 inches over the support.  To abate this violation, the employer must ensure that the platforms of ladder jack scaffolds are not more than 18 inches over the support.
