29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about October 18, 2016, during the restoration of an apartment complex balconies, located at 17603 Whitney Road, Strongsville, Ohio, the employer did not ensure an employee working from a third (3rd) floor balcony (walking/working surface) was protected from a fall of approximately 18.9 feet, by utilizing a guardrail system, safety net system and/or personal fall arrest system.
