29 CFR 1910.1200(e)(1): Employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g) and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met:    (a)  Little Colorado LLC, at 4450 Lipan Street, Denver, CO: On and preceding 10/18/16,  the employer had not developed, implemented or maintained at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f) and (g) of this section for labels and other forms of warning, and safety data sheets will be met.  Employees performed carpentry and spray finishing tasks.  The employer had not developed a written hazard communication program with regards to labeling and safety data sheets related to hazardous chemicals in their work area, including but not limited to the following:    1.  Wood dust;  2.  The Sherwin-Williams Company Sher-Wood Millwork Primer (containing 2-(2-butoxyethoxy) ethanol and talc);  3.  The Sherwin-Williams Company Sher-Wood Honey Oak Finish (containing 2-methoxymethylethoxypropanol and 2-butoxyethanol); and  4.  The Sherwin-Williams Company Sher-Wood Kem Aqua clean finish (containing 2-methoxymethylethoxypropanol and 1-(2-butoxymethylethoxy) propanol).

29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, where employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response), or equivalently, a dose of fifty percent:  (a)  Little Colorado LLC, at 4450 Lipan Street, Denver, CO: On 10/27/16, the employer did not administer a continuing, effective hearing conservation program, as described in paragraphs (c) through (o) of this section, where employee noise exposures equaled or exceeded an 8 hour time weighted average sound level (TWA) of 85 decibels measured on the A scale (slow response), or equivalently, a dose of fifty percent.  On 10/27/16 one employee operating a CNC saw to cut wood was exposed to noise at a dose in excess of the fifty percent dose Action Level.  The employee was exposed to noise at a dose of 80.7%.  This is 1.61 times the Action Level.  The employer had not implemented a hearing conservation program.  This condition potentially exposed the employee to a hazardous noise dose.

The interior of the facepiece of a Gerson model 8200 half mask air purifying respirator with organic vapor cartridge and prefilters was contaminated.  The employer did not ensure that the respiratory protection was stored to prevent contamination. This condition potentially exposed the employees to a respiratory hazard.
