29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:   (a) New residential construction located on Lot #57, Front porch roof: On or about October 20, 2016, and at times prior, the employer exposed employees to fall hazards of approximately 9-feet, 8-inches from the lower level, in that a fall protection system was not provided while installing bricks from a 4/12 pitched roof.

29 CFR 1926.1052(c)(1)(ii): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with a stairrail system along each unprotected side or edge:  (a) New residential construction located on Lot #57, First floor stairway: On or about October 20, 2016, and at times prior, the employer exposed employees to fall hazards of up to 47-inches to the lower concrete surface, in that the employer failed to install a stair rail on the open side of the staircase used to access the second floor and the porch roof area where employees were installing bricks.
