OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was exposed to a fall hazard:  a) 711 Bliss Rd., Longmeadow, MA: On or about October 20, 2016 an employee was observed climbing a fiberglass (plastic reinforced) extension ladder that did not extend 3 feet past the upper landing surface. Among other methods, feasible and acceptable means to correct this hazard is to ensure that employees follow the recommendations in ANSI A 14.5-2000 for Ladders- Portable Reinforced Plastic - Safety Requirements, specifically section 9.3.10 which states, 'when extension ladders are used to get on or off at upper levels, the top of the ladder shall extend ... three feet above the point of support at .. the roof line.

29 CFR 1910.132(a):  Protective equipment was not used wherever it was necessary by reason of hazards capable of causing injury and impairment were encountered:  a) 711 Bliss Rd., Longmeadow, MA : On or about October 20, 2016, an employee was working to service the HVAC on the unguarded roof of this building with no PFAS to protect him from falling the more than 13 feet to the ground below.  In the alternative:  29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level was not guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides:  a) 711 Bliss Rd., Longmeadow, MA : On or about October 20, 2016, an employee was working to service the HVAC on the roof of this building with no guarding on the open sides, and was not protected from falling the more than 13 feet to the ground below by any other means.
