OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards from manually lifted balloon framed walls falling back on them:  Jobsite:  An employee was paralyzed when the balloon framed wall being lifted manually fell back on top of the employees. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   (a) Jobsite: Employees were exposed to falls of approximately twenty-two (22) feet to the ground below where three window openings on the second floor had not been protected by mid-rails.  (b) Jobsite:  Employees were exposed to falls of approximately twelve (12) feet to the ground below where a window opening on the first floor had not been protected by mid-rails.

29 CFR 1926.503(a)(2)(iii): The employer did not assure that each employee has been trained, as necessary, by a competent person in the use and operation of guardrail systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used.  Jobsite:  Employees were not trained in the use of guardrail systems or other fall protection methods to prevent employees from falling while working at heights greater than six (6) feet while framing new construction residential homes.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels is not protected by guardrail systems, safety net system, or personal fall arrest system, or provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   Location:  Jobsite  This violation most recently occurred on or about November 12, 2016 where:  1) The employer does not ensure employees are protected from falling by any fall protection system exposing them to falls of approximately eighteen (18) feet to the ground below;  2) The employer does not ensure employees are protected from falls of approximately eight (8) feet nine (9) inches to the concrete below at a staircase opening.  To abate this violation, the employer must ensure that employees exposed to fall hazards over six (6) feet are provided adequate fall protection.  Pursuant to 29 CFR 1903.19, the employer must submit documents describing the steps it is taking to ensure compliance.
