29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a. The employer fails to assure effective protection against falls as required by the standard, as demonstrated on December 6, 2016, when three employees are working on a residential roof at 41 Sea Gull Drive, Ormond Beach, FL 32176 without fall protection and are exposed to falls of approximately 8 feet to the ground below.     Wayne Gonzalez Roofing Contractor, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(11), which was contained in OSHA inspection number 1166130, citation number 2, item number 1 and was affirmed as a final order on September 8, 2016, with respect to a workplace located at 5525 Osprey Ridge Drive, Lithia, FL 33547.    Wayne Gonzalez Roofing Contractor, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.501(b)(10), which was contained in OSHA inspection number 1076113, citation number 1, item number 1 and was affirmed as a final order on October 29, 2015, with respect to a workplace located at 3813 Orange Pointe Road, Valrico, FL 33596.
