OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees that were exposed while working on or underneath improperly braced trusses:    a) Davis St. Fairmont: On or about December 8, 2016, employees were installing trusses on a new residential home.  The trusses erected, were not installed in accordance with BCSI "Guide to Good Practice for Handling, Installing, Restraining and Bracing of Metal Plate Connected Wood Trusses" in that bracing for the top and bottom lateral bracing and the diagonal bracing was not installed.

29 CFR 1926.34(a): Building or structure exits were not so arranged and maintained as to provide free and unobstructed egress from all parts of the building or structure at all times when it was occupied:    a) Back of house: On or about December 7, 2016 and times prior,  employees were required to climb over top or underneath a guard rail to enter or exit a residential home under construction.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:     a) Roof Structure: On or about December 8, 2016, an employee was on the trusses of a newly installed residential home, approximately 19 feet eave to eave to ground, guiding in and installing additional trusses without the use of fall protection.     b) 2nd Floor on Front of home: On or about December 8, 2016, employees  were exposed to a fall of 11 feet while working in front 3 window openings on a two story residence.  The window openings were not protected with a guardrail systems and the employees were not utilizing fall protection.

29 CFR 1926.651(l): Walkways were not provided where employees or equipment were required or permitted to cross over excavations:    a)Back of home:  On or about December 8, 2016 and times prior, employees used a ladder laid across an excavation to gain access to the second floor of a new two story residential home.  The employer did not provide a walkway complete with guard rails to travel across the excavation.
