29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent: (a) At the band saw workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 254% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 91.7 dBA during the 317 minute sampling period, resulting in a noise hazard. (b) At the repair technician/nail gun workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 213% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 90.4 dBA during the 292 minute sampling period, resulting in a noise hazard. (c) At the repair technician/nail gun workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 172% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 86.0 dBA during the 307 minute sampling period, resulting in a noise hazard. (d) At the cut-off saw workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 114% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 85.9 dBA during the 245 minute sampling period, resulting in a noise hazard.

29 CFR 1910.134(k)(6): The employer did not provide the basic advisory information on respirators, as presented in Appendix D of 29 CFR 1910.134, in written or oral format to employees who wear respirators when such use was not required by the employer: (a) Throughout the facility, on or about December 6, 2016 and at times prior to, the employer did not provide basic advisory information contained in Appendix D to employees who used filtering face piece respirators on a voluntary basis, resulting in a respiratory and dermal hazard.
