29 CFR 1910.95(c)(1): The employer did not administer a continuing, effective hearing conservation program as described in 29 CFR 1910.9(c) through (o) whenever employee noise exposures equal or exceed an 8-hour time-weighted average sound level of 85 decibels measured on the A scale, or equivalently a dose of fifty percent:  (a)  At the band saw workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 254% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 91.7 dBA during the 317 minute sampling period, resulting in a noise hazard.  (b)  At the repair technician/nail gun workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 213% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 90.4 dBA during the 292 minute sampling period, resulting in a noise hazard.  (c)  At the repair technician/nail gun workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 172% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 86.0 dBA during the 307 minute sampling period, resulting in a noise hazard.  (d)  At the cut-off saw workstation, on or about December 7, 2016, a hearing conservation program was not implemented for the employee who was exposed to noise at 114% of the action level (8-hour time-weighted average sound level of 85 dBA) or an equivalent sound level of 85.9 dBA during the 245 minute sampling period, resulting in a noise hazard.
