The workers were observed raising and lowering the pneumatic nail guns using the tools' air hoses. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The workers were not using any form of fall protection and as such, were exposed to fall hazards of approximately 20 feet to the ground below. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

The employer did not train employees exposed to fall hazards recognize the hazards and the procedures to minimize these hazards. As such the workers were not using any form of fall protection exposing them to fall hazards of approximately 20 feet to the ground below. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. 29 CFR 1926.1051(a): Stairway(s) or ladder(s) were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more. a) 163 Sarazen Rd., Moorestown, NJ: On or about 12/13/2016, employees of Carmelo Construction Inc were conducting framing work on a new construction two story townhouse style residential structure. The workers were using the second story top plates as their walking / working surface, approximately 20 feet above the ground below. No ladder was provided to access the upper level working surface. As such, employees were observed to climb the structure's framing, exposing them to fall hazards. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
