29 CFR 1910.176(a): Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked.    a) On or about December 8, 2016, in the roll stock warehouse of the facility, employees operating forklifts and employees on foot were required to share the same permanent aisles and passageways. The employer did not ensure that permanent aisles and passageways were appropriately marked to ensure that safe clearance to prevent struck-by hazards between pedestrians and forklifts.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.178(n)(6): The driver shall be required to look in the direction of, and keep a clear view of the path of travel.    a) On or about December 8, 2016, in the roll stock warehouse of the facility, prior to backing up the Mitsubishi FGC60K clamp truck, being used in material handling operators, the operator had failed to look in the direction of travel and keep a clear view of the path of travel.  Pedestrians and other equipment operators were thereby exposed to struck by hazards.     Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.

29 CFR 1910.178(l)(6): The employer did not certify that each operator had been trained and evaluated as required by paragraph (l).  The certification did not include the name of the operator, the date of training, the date of the evaluation, and the identity of the person(s) performing the training and evaluation.  a) On or about December 8, 2016,  the employer had not certified that each industrial truck operator has been trained and evaluated in the use of powered industrial trucks as required by paragraph (l) of 1910.178, such as, but not limited to, employees operating the Mitsubishi and Cat clamp trucks without current certification.  Abatement certification required within 10 days after abatement date. The certification shall include a statement that abatement is complete, date, and method of abatement, and states employees and their representatives were informed of this abatement.
