29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:    a)  At 161 Boykin Lakes Loop, Pike Road, Alabama:  On or about January 12, 2017 and at times prior; the employer allowed his employees to use a ladder to gain access to the second floor and the rails of the ladder did not extend at least three feet above the landing to provide employees safe access exposing them to a fall hazard of 11 feet 4 inches to the ground below.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 161 Boykin Lakes Loop, Pike Road, Alabama:  On or about January 12, 2017 and at times prior; the employer allowed his employees to work from the ceiling joists without fall protection exposing them to a fall hazard of 11 feet 10 inches to the ground below.  b)  At 161 Boykin Lakes Loop, Pike Road, Alabama:  On or about January 12, 2017 and at times prior; the employer allowed his employees to work on the second floor of the home next to a wall opening without fall protection exposing them to a fall hazard of 11 feet 5 inches to the floor below.   THE OMAR GARCIA DBA  OMAR GARCIA WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 1070797 CITATION NUMBER 1, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON SEPTEMBER 2, 2015, WITH RESPECT TO A WORKPLACE LOCATED AT PROVIDENCE SUBDIVISION, LOT 12 MELISON DRIVE, PIKE ROAD, ALABAMA, AND IN OSHA INSPECTION NUMBER 1103366 CITATION NUMBER 2, ITEM NUMBER 1, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 31, 2015, WITH RESPECT TO A WORKPLACE LOCATED AT 180 BARKLEY STREET, LOT 49, PRATTVILLE, ALABAMA AND IN OSHA INSPECTION NUMBER 1184534 CITATION NUMBER 2, ITEM NUMBER 2, AND WAS AFFIRMED AS A FINAL ORDER ON DECEMBER 30, 2016, WITH RESPECT TO A WORKPLACE LOCATED AT 1250 FALLS CREST, AUBURN, ALABAMA.
