OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushing hazards: On or about January 15, 2017 employees handling bridge girders in the paint shop were exposed to struck-by and crushing hazards due to the fact that girders, 122 foot long and weighing over 44,000 pounds, were not adequately secured to prevent tipping if the girder became unbalanced. The girders were set on four 3/4 inch nuts that were placed on top of two paint stands to allow more surface area of the bottom flange of the girder to be painted and reduce the amount of touch up painting required.

Complete inspections of the crane shall be performed at intervals as generally defined in paragraph (j)(1)(ii)(b) of this section, depending upon its activity, severity of service, and environment, or as specifically indicated below. These inspections shall include the requirements of paragraph (j)(2) of this section and in addition, the following items. Any deficiencies such as listed shall be carefully examined and determination made as to whether they constitute a safety hazard: On or about January 15, 2017 a periodic inspection for the west 25 ton overhead crane had not been completed per the standard requirements within the previous 12 months.

29 CFR 1910.184(d): Inspections. Each day before being used, the sling and all fastenings and attachments shall be inspected for damage or defects by a competent person designated by the employer. Additional inspections shall be performed during sling use, where service conditions warrant. Damaged or defective slings shall be immediately removed from service: On or about January 15, 2017 the softener attachments, used to assist in the radius bend of rigging chain sets for lifting bridge girders, did not provide a smooth surface. The softeners showed damaged and/or grooves in their outer surface.

Adjustments and repairs shall be done only by designated personnel: On or about January 15, 2017 the east overhead crane was operated without the safety issues identified in the inspection report dated November 22, 2016 and marked as Safety Risks , being corrected.
