29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them. On or about January, 25, 2017, at a worksite located at 8507 Tyler Blvd., Mentor OH 44060, during steel erection activities including but not limited to hoisting and planking metal decking bundles on a structural steel building, the employer did not ensure frequent and regular inspections were being performed by a competent person who was authorized to take prompt corrective measures to eliminate hazards at this job site. Employees, including the site foreman, were not protected from fall hazards of approximately 22 3/4 feet in that although they were wearing a personal fall arrest harness, they were not tied off to any one of the three (3) tie off points that were established on top of the steel erection. Per the site foreman, there was also a written site specific Controlled Decking Zone Plan but it was left at the office and never implemented.

29 C.F.R. 1926.760(c): A controlled decking zone may be established in that area of the structure over 15 feet and up to 30 feet above a lower level where metal decking is initially being installed and forms the leading edge of a work area: On or about January 25, 2017, at a worksite located at 8507 Tyler Blvd, Mentor, Ohio 44060, during steel erection activities employees were working atop a steel erected frame approximately 22 3/4 feet above a lower level laying metal decking without adequately ensuring that a Controlled Decking Zone was established.
