29 CFR 1926.20(b)(1): It shall be the responsibility of the employer to initiate and maintain such programs as may be necessary to comply with this part.  a. On or before February 1, 2017, the employer failed to initiate and maintain a fall protection program, thereby exposing the employees to a 12 foot fall hazard.  b. On or before February 1, 2017, the employer failed to initiate and maintain a scaffolding program, thereby exposing the employees to a 12 foot fall hazard.

29 CFR 1926.451(a)(6): Scaffolds shall be designed by a qualified person and shall be constructed and loaded in accordance with that design. Non-mandatory Appendix A to this subpart contains examples of criteria that will enable an employer to comply with paragraph (a) of this section.  a. On or before February 1, 2017, where employees were working from scaffolding consisting of a pump jack, platform, and sawhorse, the scaffold was not designed by a qualified person, thereby exposing the employees to a 12 foot fall hazard.

29 CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level shall be protected from falling to that lower level. Paragraphs (g)(1)(i) through (vii) of this section establish the types of fall protection to be provided to the employees on each type of scaffold. Paragraph (g)(2) of this section addresses fall protection for scaffold erectors and dismantlers. Note to paragraph (g)(1): The fall protection requirements for employees installing suspension scaffold support systems on floors, roofs, and other elevated surfaces are set forth in subpart M of this part.  a. On or before February 1, 2017, where employees were working from scaffolding consisting of a pump jack, platform, and sawhorse, the employee was not protected from falls, thereby being exposed to a 12 foot fall hazard.

29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels shall be protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it is infeasible or creates a greater hazard to use these systems, the employer shall develop and implement a fall protection plan which meets the requirements of paragraph (k) of 1926.502. Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fall protection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complies with 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems.  a. On or before February 1, 2017, where employees were working from the roof of the house, the employees were not protected from falls, thereby being exposed to a 12 foot fall hazard.  Antonio Gonzalez DBA Sanchez Siding Services, was previously cited for a violation of this occupational safety and health standard, which was contained in OSHA inspection number 1148436, citation number 1, item number 2 and was affirmed as a final order on December 6, 2016, with respect to a workplace located at 2982 Highland Woods Blvd., Lot #73 Blacklick, OH 43004 .
