29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system: On or about February 3, 2017, and at times prior thereto, workers framing in trusses on the second story with pneumatic nail guns did not wear personal fall protection and were not otherwise protected from falling over 6 feet to the ground below or to the second floor deck.

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval. The capacity, operation, and maintenance instruction plates, tags, or decals were not changed accordingly. In no case shall the original safety factor of the equipment be reduced. On or about February 3, 2017, and at times prior thereto, the framers used a job-made, wooden trash box on the forks of the rough terrain forklift. The box was not secured to the lift with fork pockets and other positive means to prevent tipping. The load ratings for the box are unknown and the manufacturer has not approved of the attachment.
