OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that the employer did not take measures to insure the weight load capacity of the fishing boat was not exceeded. (a) Moon Lake - On or about February 10, 2017, a 20 foot aluminum Weldbilt boat with a 115 horsepower Yamaha outboard motor was loaded with fish, an insulated cooler, fishing gear, and two fishermen. The weight of the items exceeded load capacity established by the boat manufacturer.
