29 CFR 1926.1051(a): Stairways or ladders were not provided at all personnel points of access where there was a break in elevation of 19 inches (48 cm) or more, and no ramp, runway, sloped embankment, or personnel hoist was provided: a. Lot 221-226 Regency at Readington Carriages (Toll Brothers, Inc.) - Whitehouse Station, NJ The employer did not ensure a safe means of access, that included ladders or stairs, was provided to employees for access to the second level of the structure. Employees engaged in residential framing activities used the first level wall braces as a means of access to the second level deck by climbing and scaling the wall braces. Violation observed on or about February 14, 2017

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b): a. Lot 221-226 Regency at Readington Carriages (Toll Brothers, Inc.) - Whitehouse Station, NJ The employer did not ensure employees were protected from falls by use of a personal fall arrest system. Seven employees engaged in residential construction activities, working from the second level edges while installing exterior wall panels were not protected from falls by use of personal restraint systems, a safety net system, or a guardrail system. Violation observed on or about February 14, 2017 Muzza Builders, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1185093, citation number 1, item number 1 and was affirmed as a final order on January 26, 2017, with respect to a workplace located at 1017 Birch Lane, Phillipsburg, NJ - Garage 21/22.
