OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to ingoing nip points: (a) In the Pallet Production Area: On or about February 14, 2017, and at times prior, conveyor systems were not equipped with accessible emergency stop devices in areas where employees are required to be in close proximity of the moving conveyor, exposing employees to ingoing nip points.

29 CFR 1904.39(a)(2): The employer failed to report the in-patient hospitalization of one or more employees or an employee's amputation or an employee's loss of an eye, as a result of a work-related incident, within (24) twenty-four hours: (a) In the Pallet Production Area: On February 7, 2017, a laborer suffered a severe hand injury while manually transferring pallet boards from a chain conveyor to a belt conveyor. The tip of the left pinky finger was amputated. The employer failed to report the amputation within 24 hours. The injury was reported on February 9, 2017.
