29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):     a) Rockwood Apartments, Route 40, Bear, DE - On or about February 28, 2017, the employer failed to ensure employees engaged in residential roofing activities, approximately 26 feet above grade, were protected from falls by conventional means or use a personal fall arrest system.    1. The SM Contractors, LLC was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection 909031, citation number 3, item number 1 and was affirmed as a final order on October 29, 2013, with respect to a workplace located at Clayton Manor Drive, Middletown, Delaware.    2. The SM Contractors, LLC  was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(10), which was contained in OSHA inspection number 311812002, citation number 1, item number 1 and was affirmed as a final order on March 6, 2012, with respect to a workplace located at 215 New Road, Elsmere, Delaware.

29 CFR 1926.503(a)(1): The employer shall provide a training program for each employee who might be exposed to fall hazards. The program shall enable each employee to recognize the hazards of falling and shall train each employee in the procedures to be followed in order to minimize these hazards.    a) Rockwood Apartments - On or about February 28, 2017, the employer failed to provide fall protection training to employees exposed to a fall hazard of approximately 26 feet above grade and higher.    1.
