29 CFR 1926.451(c)(2)(iv): Front-end loaders and similar pieces of equipment were used to support scaffold platforms when they were not specifically designed by the manufacturer for such use:  a- Lot 11, Block 14.01, 16 Seva Court, Robbinsville NJ: On or about 04/05/17, company employees performing sheathing installation and other related activities were exposed to fall hazards in excess of 12 feet the ground surface below when working from sheets of plywood resting on the forks of a Skytrack All terrain fork truck Model Number 10054, Serial Number 0160035894.  This piece of equipment was not specifically designed by the manufacturer to support a scaffold platform.

29 CFR 1926.454(a): The employer did not have each employee who performed work while on a scaffold trained by a person qualified in the subject matter to recognize the hazards associated with the type of scaffold being used and to understand the procedures to control or minimize those hazards.  a- Lot 11, Block 14.01, 16 Seva Court, Robbinsville NJ: On or about 04/05/17, company employees performing sheathing installation and other related activities were exposed to fall hazards in excess of 12 feet the ground surface below when working from sheets of plywood resting on the forks of a Skytrack All terrain fork truck Model Number 10054, Serial Number 0160035894.  These employees were not utilizing any fall protection at the time of their exposure.  At the time of the inspection, these employees had not received training by a qualified person regarding the recognition, minimization, elimination, etc. of hazards when using a scaffold.  NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a- Lot 11, Block 14.01, 16 Seva Court, Robbinsville NJ: On or about 04/05/17, company employees performing sheathing installation, and other related activities, were exposed to fall hazards in excess of 11 feet the ground surface below when working from a residential structures pitched roof without the use of fall protection.  The pitch of this residential structure's roof is about 12 on 12.

The pitch of this residential structure's roof is about 12 on 12.  At the time of the inspection, these employees had not received training regarding the recognition, minimization, elimination, etc. of fall hazards. 29 CFR 1926.451(g)(1)(vii): Each employee on a scaffold, not otherwise specified in paragraphs (g)(1)(i) through (g)(1)(vi) of this section, more than 10 feet (3.1 m) above lower level was not protected from falls by the use of personal fall arrest systems or guardrail systems meeting the requirements of paragraph (g)(4) of this section.  a- Lot 11, Block 14.01, 16 Seva Court, Robbinsville NJ: On or about 04/05/17, company employees performing sheathing installation and other related activities were exposed to fall hazards in excess of 12 feet the ground surface below when working from sheets of plywood resting on the forks of a Skytrack All terrain fork truck Model Number 10054, Serial Number 0160035894.  These employees were not utilizing any fall protection at the time of their exposure.   ECR Construction, LLC. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.451(g)(1)(vii), which was contained in OSHA inspection number 943613, citation number 1, item number 4 and was affirmed as a final order on 12/19/13, with respect to a workplace located at 8 Kingsland Avenue, Harrison NJ.
