29 CFR 1926.416(e)(1): Worn or frayed electric cords or cables were used: Location: 19 Drago Way, White Plains, NY (a) On or about July 24, 2023, employees putting up exterior walls on a residential building were using a Makita circular saw with a missing plug. The cord had its exposed copper wires inserted into the outlet of an extension cord. (b) On or about July 24, 2023, employees putting up exterior walls on a residential building were using a DeWalt saw with a damaged cord. Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.

Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.

29 CFR 1926.1053(b)(16): Portable ladders with structural defects, such as, but not limited to, broken or missing rungs, cleats, or steps, broken or split rails, corroded components, or other faulty or defective components, were not either immediately marked in a manner that readily identifies them as defective, or tagged with "Do Not Use" or similar language, and were not withdrawn from service until repaired. Location: Location: 19 Drago Way, White Plains, NY (a) On or about July 24, 2023, employees were using a portable metal extension ladder to put up exterior walls. The halyard used to raise/lower the fly was missing. The ladder was not tagged with "Do Not Use" and was not taken out of service. (b) On or about July 24, 2023, employees were using a portable metal extension ladder to put up exterior walls. Several rungs of the ladder were damaged and bent. The ladder was not tagged with "Do Not Use" and was not taken out of service. Note: Because abatement of this violation is already documented in the casefile, the employer need not submit certification nor documentation of abatement of this violation as normally required by 29 CFR 1903.19.
