29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person:     a) Carriage House Apartments, Building #6: On or about April 10, 2017, and at times prior, the employer failed to inspect jobsites prior to the start of work, in that employees worked without adequate fall protection systems, head protection, eye protection and other PPE needed to perform roofing activities on site.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause them to lose balance and fall:    (a) Carriage House Apartments, Building #6: On or about April 10, 2017, and at times prior, the employer exposed employees to fall hazards of up to 25-feet, in that employees carried rolls of 15# felt up the ladder to prepare the roof for shingle installation.

29 CFR 1926.102(a)(1): The employer shall ensure that each affected employee uses appropriate eye or face protection when exposed to eye or face hazards from flying particles, molten metal, liquid chemicals, acids or caustic liquids, chemical gases or vapors, or potentially injurious light radiation:    a) Carriage House Apartments, Building #6, Roof: On or about 04/10/2017, and at times prior, the employer exposed employees to eye injuries while operating leaf blowers and circular saws, in that the employer failed to provide protective eyewear prior to the start of work as employees were engaged in roof removal activities.     Benjamin Sparano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.102(a)(1), which was contained in OSHA inspection number 978516, citation number 1, item number 1 and was affirmed as a final order on 08/11/2014, with respect to a workplace located at 2679 Hughes Street, Smyrna, GA 30080.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m)  or more above lower levels was not protected by guardrail systems, safety net systems, personal fall arrest systems, or an alternative fall protection measure under another provision of paragraph 1926.501 (b), nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502:    (a) Carriage House Apartments, Unit #6, Roof: On or about 04/10/2017, and at times prior, the employer exposed employees to fall hazards while working on a 6/12 pitch at eave heights over 17-feet from the lower level, in that a fall protection system was not provided by the employer as employees were engaged in roofing activities.    Benjamin Arta Sparano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13), which was contained in OSHA inspection number 1084035, citation number 1, item number 1 and was affirmed as a final order on 09/22/2015, with respect to a workplace located at 4600 Roswell Road, Sandy Springs, GA 30342.    Benjamin Arta Sparano was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.501(b)(13) , which was contained in OSHA inspection number 978516, citation number 1, item number 3 and was affirmed as a final order on 08/11/2014, with respect to a workplace located at 2679 Hughes Street, Smyrna, GA 30080.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    (a) Carriage House Apartments, Building #6, Roof: On or about 04/10/2017, and at times prior, the employer exposed employees to fall hazards of 17-feet or more while providing employees with fall protection with no training, in that employees failed to use fall arrest systems properly while engaged in roofing activities. The employer did not show the employees how to use the fall arrest systems.
